  1. Agreement 

    1. In this agreement, ‘the store’ and ‘Beyond’ refer to Beyond Games and Hobby in Bunbury and Beyond Odyssey Games and Hobby in Balcatta and their owners and employees. 

    2. The ‘customer’, ‘you’ ‘your’ refers to any individual who browses this website or who makes an order. 

    3. By using this website, you agree to the terms and conditions laid out below.

    4. Payment, pre-purchase and returns clauses also apply to our brick-and-mortar stores.

    5. Any failure (by choice or error) or delay in the applications of any clauses under these Terms by Beyond does not preclude Beyond from applying these Terms in future.

  2. Website

    1. The customer is responsible for their own use of the website. Beyond does not take responsibility for the customer’s access to the site, risks associated with accessing the site or content on externally linked sites.

  3. Pricing

    1. All prices listed on the website include GST but exclude shipping. Shipping costs are applied to your order as a whole.

    2. Product pricing may be updated without notice.

    3. Once you have placed and paid for an order, the pricing may not be changed unless an agreement is reached.

4. Payments

    1. All payments for products are non-refundable unless there is a “defect” with the product; 

    2. If a product is defective the store will exchange the product in accordance with clause 5.

    3. We reserve the right to cancel any order for any reason and provide you with a full refund.

5. Pre-purchases

    1. If a product is purchased to be ordered or is a “pre-order” the following terms apply: 

      1. For orders of $10,000 and above: 

        1. Once the product is ordered the order cannot be cancelled unless the product is no longer available; 

        2. If a pre-order/ pre-purchase is unable to be fulfilled due to the item no longer being available, the store will refund the purchase price;

        3. If a pre-order/ pre-purchase is cancelled and a refund is requested, the store is entitled to retain 10% of the purchase price; and

        4. All refunds are to be by way of Electronic Funds Transfer or returning the funds to the card used for the purchase. 

      2. For orders under $10,000;

        1. Once the product is ordered the order cannot be cancelled unless the product is no longer available; 

        2. If a pre-order/ pre-purchase is unable to be fulfilled due to the item no longer being available, the store will refund the purchase price;

        3. If a pre-order/ pre purchase is cancelled and a refund is requested, the store is entitled to retain 7% of the purchase price; and

        4. All refunds are to be by way of Electronic Funds Transfer or returning the funds to the card used for the purchase. 

    2. Beyond is not liable for any delays linked to the delivery of new releases where delays are caused by events beyond our reasonable control.

6. Returns and exchanges

  1. The store does not accept returns nor exchanges unless under the following circumstances (“return event”): 

    1. The good purchased was defective; 

    2. That if the good is returned within 24 hours of purchase, in the same condition if was purchased; or

    3. At the sole discretion of the store based on the customer’s circumstances. 

  2. If a return event occurs the store will offer the following 

    1. If the good is defective;

      1. A replacement good; or 

      2. A refund if a replacement good is unable to be sourced. 

    2. If the good is returned within 24 hours; 

      1. Store credit to the value of the good. 

    3. If a clause 6 subsection 1-3 event is triggered then the store may offer the following: 

      1. Store credit to the value of good ;

      2. Replacement of the good; or 

      3. Refund of the purchase price.
